In No Place for Ethics, Hill argues the Supreme Court has an overriding obligation to ground its judicial review responsibilities not only in the Constitution but also in ethics, understood as the Constitution's ultimate justification. The text discusses a response to the question basic to all human beings: how should I behave?

Although the ability to perform gene therapy in human germ-line cells is still hypothetical, the rate of progress in molecular and cell biology suggests that it will only be a matter of time before reliable clinical techniques will be within reach. Three sets of arguments are commonly advanced against developing those techniques, respectively pointing to the clinical risks, social dangers and better alternatives. In this paper we analyze those arguments from the perspective of the client-centered ethos that traditionally governs practice (...) in medical genetics. This perspective clarifies the merits of these arguments for geneticists, and suggests useful new directions for the professional discussion of germ-line gene therapy. It suggests, for example, that the much discussed prospect of germ-line therapy in human pre-embryos may always be more problematic for medical genetics than adult germ-line interventions, even though the latter faces greater technical difficulties. Descartes with his sharp separation of the mental and the physical set the stage for the philosophy of mind for the next 350 years. Philosopher Patrick T. Mackenzie finds in the later writings of Wittgenstein the suggestion that Descartes got off on the wrong foot. Following Wittgenstein's lead, Mackenzie argues that instead of analyzing our human nature as a composite of mind and body, we should view ourselves as whole persons. One of the dividends of this approach to the (...) mind-body problem is that it provides us with a resolution to the problem of human freedom—i.e., how can a human being be free if his or her body (including the brain) belongs to a deterministic world? Mackenzie here argues that the person is largely free even though the movements of the body are determined by neurophysiological events. He takes the same approach to the philosophy of mind as that taken by M.R.Bennett and P.M.S.Hacker in their recent and controversial book, The Philosophical Foundations of Neuroscience. Mackenzie's approach is, however, much more accessible. Students of philosophy and philosophers interested in the problem of human freedom will welcome Mackenzie's fresh approach, especially those disenchanted by the present list of mind-body "isms.". In contemporary discussion of the philosophy of religion, or for that matter of any branch of philosophy, the names of Whitehead and Wittgenstein are not often linked. Whitehead's later work is, for the most part, treated as a rather specialized interest, an attractively under-cultivated field for the enterprising thesis-writer perhaps, but well away from the main centres of current philosophical activity. And what he has to say about specifically religious or theological issues 1 becomes simply one ramification of an ingenious (...) but somewhat eccentric system. Nonetheless, there is at least this much justification for considering it in relation to the much more influential and widely discussed views of Wittgenstein. Whitehead has some original things to say about God, Wittgenstein some original reasons for thinking that Whitehead's brand of originality is here radically misplaced. And the possibility or otherwise of such theological originality is an issue of very considerable importance for the philosophy of religion. (shrink)
